The gruesome details of torture suffered by Korean activist Kim Young-hwan in China are shocking and infuriating. Any country that can put a foreigner through such unjustifiable physical and mental ordeals must be nothing more than a third-rate dictatorship. What astonishes and disappoints people all the more is that China is a G2 nation. Is the prison in the Sino-Korean border town of Dandong the Chinese equivalent of the detention camp at Guantanamo Bay Naval Base in Cuba?
We all know that China is far from a model state for freedom and human rights, considering what Beijing has done to its own citizens of Chen Guangcheng and Ai Weiwei, most recently. But it defies our understanding how the Chinese officials committed atrocities of beating, forced labor, sleep deprivation and electric torture on foreigners just because they worked for the human rights of refugees, even although the latter were illegal aliens from Beijing’s point of view.
Even harder to understand is the Seoul government’s initial response of seemingly playing down the harm suffered by its citizens. We don’t see why it took almost a month for a Korean consul to meet Kim and his coworkers. It doesn’t take more than a day for diplomats from the United States and Japan to interview their citizens if detained by host governments. What has kept Seoul from revising their consular accord to a level equivalent to that followed by other nations?
The Korean diplomats reportedly heard and knew about the torture when they first saw the victims but have since said and done nothing about it. If such acquiescence was the condition for setting them free, Seoul should have not have agreed to this in the first place, however urgent securing their release was. We are afraid the Chinese government’s flat denial of any acts of torture is due to such informal accord, and a lack of physical evidence.
If Beijing is so confident of their officials’ innocence, there are no reasons why it should not reopen the case by allowing Kim, who said he remembers his torturers and other details, such as the chronology of his ordeal, to meet them in person. The South Korean government is right to demand, albeit belatedly and pushed by public opinion, that China reinvestigate the case, punish those responsible, make an apology and promise to prevent the recurrence of similar incidents. Beijing is urged to show it is a civilized global leader by sincerely responding to it.
Cheong Wa Dae is vowing to do all it can to rectify China’s maltreatment of Korean nationals, saying it would help activists bring the case to international organizations and even interview all of about 620 Korean detainees in China. Again, these are right moves but give the impression of going somewhat too far, too late.
China’s treatment of the Korean activists is inexcusable, but its basic stance reflects Beijing’s diplomatic viewpoint. For Seoul, North Korean refugees are an issue for human rights and protecting compatriots, but for Beijing, it is an issue of national security and inter-Korean relationships. It suspects, not without reason, that the Lee Myung-bak administration’s hard-line North Korea policy is aimed at triggering the collapse of the Pyongyang regime, resulting in a huge influx of refugees into its territory.
Provided China shows a more humane approach in dealing with activists and refugees, Seoul needs to have is a cool-headed, more fundamental diplomatic perspective.

고문을 둘러싼 논란
한국과 중국은 냉정한 해결책을 찾아야 한다
한국인 활동가인 김영환 씨가 중국에서 겪은 고문의 끔찍한 세부 내용은 충격적이고 분노를 자아낸다. 어느 나라라도 외국인을 이처럼 정당화할 수 없는 육체적 정신적인 고초로 밀어 넣는다면 3류 독재국가 그 이상일 수가 없다. 사람들을 더욱 더 경악하고 실망하게 만든 것은 중국이 G2국가라는 사실이다. 한-중 국경의 단동 시에 있는 감옥이 쿠바 관타나모의 해군기지에 있는 수용소의 중국판이라도 되는 건가?
중국 정부가 가장 최근 천 광청이나 아이 웨이웨이같은 자국 시민들에게 한 짓으로 볼 때 우리 모두는 중국이 자유와 인권의 모범 국가와는 거리가 멀다는 것을 알고 있다. 그러나 어떻게 중국 관리들이 비록 중국 정부의 관점에서는 불법 체류 외국인들이라도 난민들의 인권을 위해 일했다는 이유만으로 외국인들에게 구타와 강제 노동, 잠 안 재우기 및 전기 고문 같은 만행을 저지를 수 있는지 이해가 안 된다.
심지어 더 이해가 안 되는 것은 마치 자국 시민들이 당한 해악을 경시하는 듯한 한국 정부의 최초 반응이다. 우리는 어째서 한국 영사가 김영환 씨와 그 동료들을 만나는데 거의 한 달이 걸렸는지 그 이유를 알지 못한다. 미국이나 일본 외교관들은 자국민들이 주재국 정부에 의해 억류 당하면 접견하는데 하루 이상이 걸리지 않는다. 무엇 때문에 한국 정부는 영사 협정을 다른 나라들 수준으로 개정하지 못했는가?
한국 외교관들은 처음 피해자들을 만났을 때 고문에 대해 들어서 알고 있었지만 이에 대해 어떤 말이나 행동도 하지 않았다. 이러한 묵인이 그들 석방의 조건이었다면 한국 정부는 아무리 그들의 석방이 시급했더라도 애당초 이런 합의를 하지 말았어야 했다. 우리는 중국 정부가 어떤 고문도 없었다고 딱 잡아 떼는 것이 이러한 비공식 합의와 또한 물리적인 증거가 없기 때문이 아닌가 하는 걱정이 든다.
중국 정부가 자기 관리들의 결백에 대해 그토록 자신한다면 자신을 고문한 사람들과 자기가 겪은 고초의 시간 별 세부 사항 등을 모두 기억한다는 김영환 씨를 그들과 직접 만나게 함으로써 이 사건을 재조사하지 못할 이유가 없다. 한국 정부가 비록 뒤늦게 여론에 등 떠밀려서 나마 중국에게 이 사건을 재조사하고 책임자를 처벌하며 사과하고 비슷한 사건의 재발 방지를 약속하라고 요구하는 것은 옳은 일이다. 중국 정부는 이에 대해 성실하게 답함으로써 자신이 문명화된 세계의 지도국가임을 보여줄 것을 촉구한다.
청와대는 활동가들이 이 사건을 국제기구에 제소하는 것을 돕거나 심지어 중국에 억류중인 620여 명의 한국인 전원을 면담하겠다는 등 중국의 한국 국민에 대한 학대를 교정하기 위해 할 수 있는 모든 것을 하겠다고 다짐하고 있다. 다시 말하건대 이런 움직임들은 옳지만 너무 늦게 약간 너무 나아간다는 인상을 준다.
중국이 한국 활동가들을 다룬 방식은 변명의 여지가 없지만 근본 자세는 중국 정부의 외교 관점을 반영하는 것이다. 한국 정부에게 북한 탈북자들은 인권과 동포의 보호라는 문제이지만 중국정부에게 이는 국가 안보와 남북 관계의 문제이다. 그들은 이명박 정부의 대북 강경책이 북한 정권의 붕괴를 초래하는 것을 목표로 하고 있으며 그 결과 자신의 영토로 엄청난 난민이 쏟아져 들어오는 것이 아닌가 하는 의심을 하고 있는데 그럴 만한 이유가 전혀 없는 것도 아니다.
중국이 활동가와 탈북자들에게 보다 인간적인 접근법을 보여 준다는 전제 하에 한국정부에게 필요한 것은 냉정하고 보다 근본적인 외교적 시야이다. |
